Terms of Service
Effective July 2026
These terms govern your use of The Book Care. The short version: register only books you own the rights to, we act as your agent to get pirated copies taken down, and the perjury attestation behind each notice is yours.
1. The service
The Book Care monitors the web for pirated copies of books you register, gathers evidence of infringement, and prepares and dispatches DMCA takedown notices to hosts, registrars, and search engines on your behalf. It is a monitoring and enforcement tool; it is not a law firm and does not provide legal advice.
2. Authorized-agent appointment
By registering a book and enabling enforcement, you appoint The Book Care as your authorized agent for the limited purpose of issuing and managing DMCA takedown notices (and equivalent notices under other jurisdictions' laws) for that work, including receiving responses and counter-notices addressed to those notices.
If a recipient files a counter-notice, we forward it to you promptly. Deciding how to respond to a counter-notice — including whether to pursue the matter further — is yours, with your own counsel.
3. Your warranties
You warrant that you own the copyright in each work you register, or are expressly authorized by the owner to act for it, and that the information you provide about each work is accurate. Takedown notices are sent based on your attestation, made under penalty of perjury, that you hold those rights.
Knowingly misrepresenting ownership or infringement exposes you to liability under 17 U.S.C. § 512(f). We may suspend enforcement for any work whose ownership we cannot reasonably verify, and we may decline to send any notice our review flags as unreliable (for example, likely fair use).
4. Plans & credits
Paid features are consumed via plan allowances and credits as described on the pricing page inside the app. Credits fund scans and enforcement actions; a failed scan attributable to our systems is not charged. Fees are otherwise non-refundable except where required by law.
5. Acceptable use
You may not use the service to target content you do not hold rights to, to harass site operators, to send notices you know to be false, or to probe or disrupt the service itself. We may suspend or terminate accounts that do.
6. Indemnification
You agree to indemnify, defend, and hold harmless The Book Care, its operator, and its personnel from any claim, demand, damages, or expense (including reasonable attorneys' fees) arising from a breach of your warranties in Section 3 — in particular, from any takedown notice sent in reliance on an ownership attestation that was inaccurate, or from your registration of a work you did not hold rights to. This includes claims brought under 17 U.S.C. § 512(f) by recipients of such notices.
7. Disclaimers & liability
Piracy enforcement is adversarial and no outcome can be guaranteed: some hosts ignore valid notices, some sites reappear under new domains, and search de-indexing is at the search engine's discretion. The service is provided "as is", and to the maximum extent permitted by law our aggregate liability for any claim arising from the service is limited to the fees you paid us in the twelve months before the claim.
We may update these terms as the service evolves; material changes will be announced in-app or by email before they take effect. Continued use after the effective date constitutes acceptance.
